Join our next Annual Conference
The Annual Conference provides a unique opportunity for both practitioners and academics to discover the most significant tort law developments from across Europe in 2022. Experts from each of the many jurisdictions represented will present selected highlights from their contributions to the European Tort Law Yearbook, an annual volume which provides a comprehensive overview of legislative and judicial developments in tort law throughout Europe during the preceding year. (The Yearbook ‘European Tort Law 2022’ will be published in autumn 2023.) The national reports will be followed by an overview of EU law developments and a comparative, concluding summary, which will critically assess the most important trends and issues to emerge.
The Conference concludes with a special session on ‘Prospectus Liability’. The Prospectus Regulation has defined uniform requirements as to the content of a prospectus to be issued in the context of a public offering of securities in the EU. Yet the legislator has abstained from addressing the liability attached to the violation of these requirements. The uniformisation of the rules on liability would not only make the Regulation more effective and level the playing field for securities issuers in the Union's capital market, but would also exclude intricate conflict-of-laws problems that regularly arise in prospectus liability cases. Through a comparative investigation into the laws of several European countries and the law of the U.S. with its decade-long experience in the area, we try to show that such uniformisation is both necessary and feasible.
