Through the looking glass. Liability for AI in Italy. The Legislative Decree 160/2026 and its impact on the Italian system of civil liability rules. A first outlook.
This presentation provides an initial overview, analysis and commentary on Legislative Decree No. 160/2026 of 30 September 2026 and its relevance to the field of civil liability rules for artificial intelligence. In addition to examining the individual provisions of the Decree, the presentation seeks to place it within the broader framework of existing Italian civil liability law and to explore its interaction with the new European New Product Liability Directive (NPLD).
Claire Stalenhoef
Claire Stalenhoef is a PhD Candidate at Maastricht University (the Netherlands), where she is writing a dissertation on the handling and settlement of cross-border motor third-party liability (MTPL) claims in Europe.
The handling and settlement of cross-border MTPL claims in Europe.
Within the legal framework governing cross-border MTPL claims two systems play an important role in the handling of such claims: the Green Card system and the Protection of Visitors system. Although the systems perform comparable functions, they differ in their historical development, legal foundations, geographical scope and operation. In this presentation, Claire will examine the development and functioning of both systems, and particularly the relationship between the two systems. Particular attention is paid to the legal implications of their different foundations and operations. These issues are considered in light of the main research question of her thesis: How do the Green Card system and the Protection of Visitors system facilitate the handling of cross-border MTPL claims in Europe, and to what extent does their operation contribute to the underlying objectives of both systems, namely the facilitation of cross-border mobility and victim protection?
Each presentation is scheduled for 20 minutes, with an opportunity for discussion afterwards.
The event will take place in the Seminar Room of ECTIL/ETL (Reichsratsstraße 17/2, 1010 Wien). Participation is free of charge. If you would like to attend, please register via etl(at)oeaw.ac.at.
