1. A Portuguese teacher bought an action for losses occasioned through the failure of his school's administration to send in an application that would have improved the evaluation and valuing of his job.
As a result he lost out on the chance of a higher income along with suffering anxiety, stress and sadness. He claimed around €34k. In the course of comprehensively ruling out damages for the lost chance of higher earnings, albeit that the plaintiff did recover €10k in non-pecuniary damages for his suffering, the Supreme Court of Justice cited both articles 3:101 and 2:105
of the PETL.
2. Meanwhile in a decision of before the Colombian Supreme Court of Justice (24.08.09) the Court cited a number of articles including the basic norm set out at 1:101. The text of the judgement can be found here
