Juristenrunde: The New Chinese Tort Liability Law. What is going to change as of July, 2010
On June 1st Mag. Laura Ascher from the Institute for Zivilrecht at the University of Vienna Law Faculty delivered a Juristenrunde on the forthcoming Chinese Tort Liability Law (which comes into force on 1st July 2010) which was attended by many of the staff of the ETL, ECTIL and the Institute for Zivilrecht.
The presentation (drawn from which covered historical aspects of Chinese law generally, specifically with regard to Tort liability along with current law, the tangled process of drafting that the coming law underwent and the substantive changes that the new law will bring. It prompted many questions, ably handled, on diverse legal topics and left the audience well sated.
ETL has been increasingly involved in exchanging ideas with Chinese tort scholars and this lecture was a timely reminder of the exciting and challenging road ahead as a process that has seen many European Tort lawyers offering their own national perspectives to a receptive Chinese body of scholars comes to an end and the law on paper is thrown into the cauldron of the wider world.
