'After five years as Director of the Institute for European Tort Law, I shall be leaving my post at the end of 2013. Though I was flattered to have been offered a new term of office as Director, I think the time is now right for me to return to the United Kingdom, where I shall resume my position as Professor of Tort Law at the University of Bristol. I am confident that I leave the Institute in fine shape to withstand the challenges of the coming years. In January of this year, an international panel of evaluators appointed by the Austrian Academy of Sciences rated the Institute's research as "internationally outstanding" (the top rating), which constitutes fitting recognition for the solid foundations laid by my predecessor, Helmut Koziol, and the hard work done over many years by Institute staff. I have been extraordinarily lucky to have had the opportunity to work with such wonderfully talented and enthusiastic people during my time in Vienna. It is naturally with more than a tinge of sadness that I leave, but I comfort myself with the knowledge that my departure does not mark the end of my involvement with the Institute, but merely its continuation in an altered form, as I shall remain active in the Institute's ongoing research.

From 1 January 2014, Professor Ernst Karner of the University of Vienna, will step up from his current role as Deputy Director of the Institute to act as interim Director, and I wish him and all the staff every success in 2014 and beyond.'

The European Tort Law Yearbook provides a comprehensive overview of the latest developments in tort law in Europe. It contains reports from the majority of European jurisdictions, as well as a comparative analysis that identifies emerging trends. Focusing on the year 2012, the authors critically assess important court decisions and new legislation, and provide a literature overview.

The papers in this collection are drawn from a symposium held in Vienna in December 2010. Organised by the Institute for European Tort Law and the Chicago-Kent Law Review, in collaboration with the European Centre of Tort and Insurance Law, the conference drew together legal experts from 14 national or regional systems across six continents. Medical malpractice and compensation for medical injuries are issues which regularly create tension and innovation in national legal systems but the analysis of these areas is often limited to national audiences. This study examines the issues in a uniquely global context, demonstrating the breadth of approaches currently taken around the world and revealing key areas of tension and the likely direction of future developments. Wherever possible, the analysis is supported by reference to empirical data. The 14 legal systems covered in the collection are Austria, Brazil, Canada, China, France, Germany, Italy, Japan, New Zealand, Poland, Scandinavia, South Africa, the United Kingdom and the United States. A general comparative introduction completes the collection.

The Institute for European Tort Law and the University of Geneva will be collaborating once again in furtherance of the Digest of European Tort Law series. This study – on Misconduct – would not be possible without the generous auspices of the Austrian Science Fund and the Swiss National Science Foundation.
 
The new volume was the subject of a Conference – Digest of European Tort Law: Presentation of the Research Project on ‘Misconduct’ – on Monday, 11 November 2013. A meeting also took place between 11–12 November 2013 in which the Questionnaire was discussed.
 
The Editors of the project (Prof Ernst Karner, Prof Ken Oliphant, Prof Alessandro Scarso, Prof Benedict Winiger) would like to express a hearty thanks to Prof Scarso for his charitable hospitality.
